AGREEMENT TO TERMS

By placing an order with Tape Arcade ("we," "us," or "our"), you ("customer," "you") agree to these Terms of Service.

If you do not agree, do not use our services.

DESCRIPTION OF SERVICES

Tape Arcade provides media digitization services, including converting analog formats (such as VHS and similar media) into digital files.

We do not guarantee:

Results depend entirely on the condition of the original media.

SHIPPING & RISK OF LOSS

4.1 OUTBOUND SHIPPING (CUSTOMER → TAPE ARCADE)

4.3 GENERAL RISK DISCLOSURE

Media may be lost, delayed, or damaged during shipping or processing.

HANDLING OF MEDIA

We take reasonable care in handling all media. However, you acknowledge that:

You accept the risk that media may be damaged or rendered unusable during normal processing.

LIMITATION OF LIABILITY

To the maximum extent permitted by law:

  • Tape Arcade's total liability for any claim is limited to the amount you paid for the services related to that order
  • Tape Arcade is not liable for loss of irreplaceable or sentimental value, emotional distress, or indirect, incidental, or consequential damages

This limitation applies regardless of the cause of loss, including shipping issues, equipment failure, or media degradation.

INSURANCE

We may insure shipments at our discretion. Insurance coverage is subject to carrier terms and limitations and does not represent or guarantee full replacement value of media.

Customers acknowledge that the value of original media may exceed any available insurance coverage.

DIGITAL FILE DELIVERY

8.1 DELIVERY METHOD

Completed files will be delivered via secure download link, or optional USB drive if purchased.

8.2 RETENTION PERIOD

Files will be available for download for 30 days from the date of delivery. After this period, files may be permanently deleted without notice.

8.3 CUSTOMER RESPONSIBILITY

You are responsible for downloading files within the retention period and creating backup copies. Tape Arcade is not responsible for loss of files after delivery or failure to download within the retention window.

PRIVACY & DATA HANDLING

We collect limited personal information necessary to fulfill your order. Order status information may be accessible via our status page using order-specific identifiers.

ORDER ISSUES & CLAIMS

Any issues must be reported within 7 days of delivery of your returned media or digital files. Failure to report issues within this timeframe may result in denial of the claim.

PROHIBITED CONTENT

You agree not to submit illegal content or copyright-infringing material without authorization. You are solely responsible for the legality of submitted media.

REFUND POLICY

Due to the nature of digitization services, services are considered fulfilled once processing has begun. Refunds are not guaranteed and are issued at our discretion.

MODIFICATIONS TO TERMS

We may update these Terms at any time. The version in effect at the time of your order will apply to your transaction.

GOVERNING LAW

These Terms are governed by the laws of the State of Michigan.
